Dispute over 55x40x20 cm carry-on luggage: consumer protection sues over extra charges
Free carry-on luggage or extra charges? This question currently concerns not only air travellers but also the courts. The Federation of German Consumer Organisations (vzbv) has issued warnings to and sued several airlines over allegedly unlawful carry-on fees. The aim is that a cabin trolley or small suitcase in standard carry-on dimensions may be taken on board free of charge with every airline in future.
What triggered the dispute?
More and more airlines – above all low-cost carriers such as Ryanair, WizzAir, easyJet, Vueling, Transavia, Volotea and Norwegian Air – only allow a very small piece of hand luggage (e.g. a handbag or laptop bag) in their cheapest fare.
For a cabin trolley with the usual dimensions of 55 x 40 x 20 cm, they often charge extra fees.
According to a 2014 ruling of the European Court of Justice (C-487/12), however, carry-on luggage is an indispensable part of the air transport contract and may not simply be declared a paid extra service. The consumer advocates are now relying on this in court.
What consumer advocates are demanding
- Uniform carry-on dimensions: at least 115 cm in total (e.g. 55 x 40 x 20 cm)
- A weight limit of 10 kg for the larger piece of carry-on luggage
- Free of charge, in addition to a small personal item
- Clear and transparent carry-on rules at all airlines
What does this mean for air travellers?
If the lawsuits succeed, carry-on rules in the EU could be harmonised. Extra charges for cabin trolleys would then be a thing of the past in many cases.
Until then: always check the baggage rules before booking to avoid fees or discussions at the gate.
