1. Scope

These General Terms and Conditions (GTC) apply to all orders placed via our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.

For entrepreneurs the following applies: If the entrepreneur uses conflicting or supplementary General Terms and Conditions, their validity is hereby objected to; they shall only become part of the contract if we have expressly agreed to them.

2. Contractual Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with Sagenta GmbH.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You may place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded by clicking the order button to accept the offer for the goods in the shopping cart. Immediately after submitting the order, you will receive another confirmation by email.

3. Contract Language, Storage of Contract Text

The language(s) available for the conclusion of the contract: German, English, French

We store the contract text and send you the order data and our GTC in text form. You can view the contract text in our customer login area.

4. Delivery Conditions

4.1 Shipping Costs

Standard shipping is free of charge for orders of 100 € or more including VAT.

4.2 Delivery Options

We deliver the products to the delivery address specified in the order process.

You can also collect the goods from Sagenta GmbH, Großbehrenstraße 174, 12277, Germany during the following business hours: Mon. - Fri. 10 am - 3 pm

We do not deliver to packing stations.

5. Payment

5.1 Prices

The prices stated at the time of the order apply. These are total prices and include statutory VAT.

5.2 Payment Methods

The following payment methods are generally available in our shop.

Prepayment
When selecting prepayment, we will provide our bank details in a separate email and deliver the goods after receipt of payment.

Cash on collection
You pay the invoice amount in cash upon collection.

Credit Card
During the order process, you enter your credit card details. Your card will be charged immediately after placing the order.

Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have Apple Pay activated, authenticate yourself and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information is provided during the ordering process.

Giropay
In cooperation with the payment service provider paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt a. M., we offer the payment method giropay. To pay via giropay, you need an online banking-enabled bank account, authenticate accordingly, and confirm the payment instruction. Your account will be debited immediately after placing the order. More information is provided during the ordering process.
Giropay may offer additional payment options to registered and selected customers. We have no influence on these options; any additional options concern your legal relationship with giropay. For more details, refer to your giropay account.

PayPal Express
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself, and confirm the payment instruction.

PayPal may offer additional payment options to selected registered customers. We have no influence over these; they concern your legal relationship with PayPal. For more details, refer to your PayPal account.

Sofort by Klarna
To pay via Sofort GmbH, Theresienhöhe 12, 80339 Munich, you need an online banking-enabled bank account, authenticate accordingly, and confirm the payment instruction. Your account will be debited immediately after placing the order. Further information is provided during the ordering process.

6. Right of Withdrawal

Consumers have the statutory right of withdrawal as described in the withdrawal policy. Entrepreneurs are not granted a voluntary right of withdrawal.

7. Retention of Title

The product remains our property until full payment has been made.
For entrepreneurs, the following applies additionally: We retain ownership of the product until all claims from an ongoing business relationship have been settled. You may resell the goods in the ordinary course of business; all claims arising from this resale shall be assigned to us in advance – in the amount of the invoice value – regardless of whether the goods have been combined or mixed with a new item. We accept this assignment. You remain authorized to collect the claims, but we may also collect them ourselves if you fail to meet your payment obligations. Upon your request, we will release the securities to which we are entitled insofar as the realizable value of the securities exceeds the claims to be secured by more than 10%.

8. Transport Damage

For consumers: If goods are delivered with obvious transport damage, please report such defects to the delivery agent immediately and contact us without delay. Failure to make a complaint or contact us will not affect your legal rights or their enforcement, particularly your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.

For entrepreneurs: The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the item to the carrier, freight forwarder, or any other person or institution designated to carry out the shipment.

12. Final Provisions

If you are an entrepreneur, German law applies under exclusion of the UN Convention on Contracts for the International Sale of Goods.

If you are a merchant under the Commercial Code, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our registered office.
